Terms of Service

ACCEPTANCE OF TERMS AND CONDITIONS OF ACCESS. These Terms of Service ("Terms") govern access to and use of the platform, software, APIs, voice widgets, and consulting services provided by Growth Genesis LLC ("We"). By using our services, you ("The User") unconditionally accept these Terms, which prevail over any prior purchase order or verbal agreement. Access to our services is strictly limited to commercial entities and professionals over the age of 18; use by end consumers for non-commercial personal purposes is prohibited unless explicitly stated. You are solely responsible for maintaining the confidentiality of your access credentials and API keys. Any activity conducted under your account is presumed authorized by you. Growth Genesis reserves the right to audit your use of the service at any time and to immediately suspend any account exhibiting suspicious traffic patterns, unauthorized access attempts, or security violations, without prior notice and without liability for reimbursement.

ACCEPTABLE USE POLICY AND PROHIBITED RESTRICTIONS. You agree to use our AI and automation services exclusively for lawful and ethical purposes. It is strictly prohibited, and shall constitute a material breach of this contract, to: (i) use the services to generate fraudulent content, "deepfakes," hate speech, harassment, or sexually explicit material; (ii) attempt to reverse engineer, decompile, disassemble, or discover the source code, underlying ideas, or algorithms of our platform or our providers (such as OpenAI or VAPI); (iii) use the services to develop a competing product or train other artificial intelligence models; (iv) send unsolicited communications (SPAM) in violation of the CAN-SPAM Act or local regulations; (v) perform "Prompt Injection" attacks or attempt to manipulate the security safeguards of our AI Agents. Growth Genesis actively monitors traffic for these violations and will cooperate fully with legal authorities in the event of criminal use, handing over IP logs, voice recordings, and transcripts if required by court order.

BILLING, SUBSCRIPTIONS, AND CANCELLATION POLICY. Subscription services (SaaS) and maintenance fees are billed in advance. You authorize Growth Genesis LLC to automatically charge your registered payment method at the beginning of each billing cycle. It is your responsibility to keep billing information updated. NO REFUND POLICY: All payments are final. We do not offer prorated refunds for mid-month cancellations, nor refunds for consulting services or "Setup Fees" once work has commenced or infrastructure has been provisioned. In the event of payment failure, we shall be entitled to suspend the service immediately. If an account remains unpaid for more than 30 days, we reserve the right to permanently delete your data, configurations, and associated phone numbers without possibility of recovery. You waive any right to set-off or withhold payments for minor service disputes.

PROPRIETARY RIGHTS AND LIMITED LICENSE TO USE. All software, visual interfaces, graphics, design, compilation, computer code (including source and object code), products, software, services, and all other elements of the Service provided by Growth Genesis LLC are owned by Growth Genesis or its licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your internal business purposes. You do not acquire any ownership rights in the underlying infrastructure. Any feedback, suggestions, or ideas you provide regarding the service become the exclusive property of Growth Genesis and may be used for product improvements without any compensation to you.

TERMINATION AND DISCLAIMER OF WARRANTIES. Growth Genesis LLC reserves the right to terminate or suspend your access to the Service at any time, with or without cause, and with or without prior notice, effective immediately. Upon termination, your right to use the Service will cease immediately. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". We disclaim all warranties, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, nor that the results obtained from the use of the AI will be accurate or reliable. You assume all risks associated with the quality and performance of the service. This section shall survive the termination of this agreement and shall be construed under the laws of the State of Florida.
